Terms of service

Effective September 9, 2026. These terms cover your use of mrsdavids.com and any order you place with us.

1 Who we are

Mrs Davids Creations LLC (“Mrs Davids Creations,” “MDC,” “we,” “us”) is a Pennsylvania limited liability company operating a registered Limited Food Establishment in the Pittsburgh area. You can reach us at hello@mrsdavids.com.

2 Agreeing to these terms

By browsing our site or placing an order, you agree to these terms, along with our Refund & Remedy Policy and Privacy Policy, which are part of them. If you don’t agree, please don’t order.

3 Placing an order

You must be at least 18 to place an order. You’re responsible for the accuracy of what you enter — flavors, quantities, pickup window, shipping address, and email.

An order isn’t confirmed until we accept it. We may decline or cancel any order, including after it’s placed, if an item is unavailable, a price or product description was posted in error, we can’t serve your address, or we suspect fraud or resale. If we cancel, we refund what you paid for the canceled order.

Everything we make is in limited quantities and seasonal flavors come and go. Availability shown on the site isn’t a guarantee.

4 Prices and payment

Prices are in U.S. dollars and may change at any time. The price that applies is the one shown when you check out. Payment is due in full at checkout and processed by our payment providers — we never see or store your full card details. Applicable taxes and shipping are calculated at checkout.

5 Shipping and pickup

We ship nationwide on Tuesdays, with a Sunday cutoff for that week’s shipment, and we offer local pickup on designated dates and windows. Full details, including how to change an order, are on our Shipping & Pickup page and form part of these terms.

Risk of loss passes to you when your package is accepted by the carrier. Delivery estimates are the carrier’s, not ours, and we aren’t liable for carrier delays. We ship without refrigeration or cold packs and don’t guarantee against softening or melting in warm weather.

Pickup orders not collected within your window are held through that day’s pickups. One reschedule is available if you contact us. Without contact within 48 hours of your window, the order is forfeited without refund.

6 Perishable food, storage and care

Our cookies are fresh-baked perishable food with no artificial preservatives. Once your order is delivered or picked up, proper storage is on you. We recommend enjoying them within about 5 days, sealed and at room temperature, or freezing them for longer keeping. We aren’t responsible for quality issues arising from storage after delivery.

7 Ingredients and allergens

Our products are made in a kitchen that handles wheat, dairy, eggs, tree nuts, and peanuts, and some purchased ingredients contain soy. All products are made in the same space using shared equipment. We cannot guarantee that any product is free from any allergen or from cross-contact. If you have a food allergy, sensitivity, or dietary restriction, you are responsible for deciding whether our products are right for you, and we recommend against ordering where an allergy is severe. Ingredient information we provide is offered in good faith; recipes and suppliers may change.

8 Refunds, replacements, and credits

All sales are final. We don’t accept returns or exchanges on perishable food and don’t offer refunds as a matter of course. Where an order arrives wrong, incomplete, damaged, or genuinely defective, we resolve it with a replacement or store credit as set out in our Refund & Remedy Policy, which governs. Claims must reach us within 7 days of delivery or pickup, with photos.

9 Custom, wholesale, corporate, and event orders

These are quoted individually and confirmed by a 50% deposit. Deposits are refundable if you cancel more than 30 days before your scheduled date, and non-refundable within 30 days, at which point the order can no longer be canceled. Any additional written terms we agree for a specific order control over this section where they conflict.

10 Gift cards

Gift cards are issued for the amount purchased, don’t expire, and are non-refundable. They can’t be redeemed for cash except where the law requires it, and they can’t be replaced if lost or shared — treat one like cash.

11 The Cookie Society

Joining the Cookie Society means you’re opting in to marketing emails from us. You can unsubscribe from any email at any time, and we’ll stop. We don’t sell your information. We don’t currently send text messages; if we ever do, we’ll ask for your consent separately and specifically.

12 Reviews, photos, and tagging us

When you submit a review, comment, or photo to us, or tag us publicly on social media, you give us permission to use, reproduce, and share that content in our marketing, with credit to your name or handle where practical. You keep ownership of what you post. Don’t submit anything you don’t have the right to share, and we may decline to publish or may remove content that’s unlawful, misleading, or abusive.

13 Our brand and recipes

Our name, logo, flavor names, tagline, recipes, formulations, photography, and site content are our property and protected by law. You may share our public photos and posts on social media with credit. You may not copy our recipes or content for commercial use, or use our name or branding in a way that suggests we endorse or supply you, without our written permission.

14 Discounts and promotions

Discount codes are for personal use, limited to one per order unless we say otherwise, cannot be combined, have no cash value, and may be modified or ended at any time. We may void a code and cancel an order where a code is resold, shared broadly, or used in a way it clearly wasn’t meant to be.

15 Reselling

Products bought through our retail store are for personal use and gifting. Reselling them commercially requires a wholesale arrangement with us in writing. Reach out at hello@mrsdavids.com — we’d love to talk.

16 Disclaimers and limits on liability

Our products are sold as-is for personal consumption. Beyond what these terms and our Refund & Remedy Policy expressly provide, and to the fullest extent the law allows, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

To the fullest extent permitted by law, our total liability for any claim connected to an order is limited to the amount you paid for that order. We aren’t liable for indirect, incidental, or consequential damages — including lost profits or the cost of replacing an item for an event. Nothing here limits liability the law doesn’t allow us to limit.

Our site is provided as-is. We aim to keep product information, pricing, and availability accurate, and we may correct errors at any time.

17 Payment disputes

If there’s a problem with your order, please contact us before disputing a charge with your bank — we resolve nearly everything within a day or two. We may decline future orders from customers who file chargebacks on orders that were delivered as described.

18 Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Allegheny County, Pennsylvania, and we each consent to those courts.

19Changes to these terms

We may update these terms, and the version posted here with its effective date is the one that applies. The terms in effect when you place an order govern that order.

20Everything else

If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing a provision right away doesn’t waive it. These terms, together with our Refund & Remedy Policy, Shipping & Pickup page and Privacy Policy, are the whole agreement between us about your order.
